INTRODUCTION
This website is owned and operated by Jean Synodinos (Artist). The (many, many) words that follow set forth the terms and conditions under which you may enjoy this website and its store. jeansynodinos.com offers an opportunity to explore the Artist’s original music, artwork, and writing; it includes a storefront that sells both physical and digital products. By using this website and/or purchasing music or art, you approve that you’ve read, understood, and agree to be bound by these Terms.
The website and its store are intended for individuals over 18 years of age who possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You aren’t allowed to use this website and/or purchase products if so doing would break any laws that apply to you in whatever country you live.

SALES
The price for each product in the store is listed on this website. The Artist reserves the right to change the products that are available, change the prices for products displayed at any time, and correct pricing errors that may inadvertently occur. Like you, the Artist in question is only human, happy to fix problems and apologize for her mistakes.
Any additional fees, such as sales tax or shipping charges, will be automatically added to your purchase at checkout.
SHIPPING
The Artist makes every effort to pack and ship each purchase quickly, generally between 1-3 days unless otherwise notified. All items will be insured for their purchase price. The choice of shipping provider (USPS, UPS, FedEx, etc.) is at the sole discretion of the Artist and will be chosen based on both price and delivery schedule. That said, delivery times are difficult to predict. The Artist will confirm that a shipment has been made but is not responsible for transit delays that may be incurred by circumstances beyond her control—global pandemics, unusual Acts of both Man or God, that sort of thing.
At present, physical products are only shipped to locations in the continental United States.
RETURN & REFUND POLICY
DIGITAL PRODUCTS: There are no refunds for digital products. All sales are final.
PHYSICAL PRODUCTS: There is a 30-day return policy (for refund or exchange) for original art, prints, concrete items, compact discs, or other physical items for sale in the online store. Please contact Jean if you are unhappy with your purchase for any reason at jean@jeansynodinos.com. You are asked to return the undamaged item in either a) its original packaging materials (preferred), or b) comparably safe and secure packaging. Once returned in good condition, the Artist will refund the original purchase price, or you may apply funds towards any other item(s) in the store. PLEASE NOTE: You are responsible for paying return shipping costs, including insurance to cover the item’s original purchase price.
DAMAGED ITEMS: Should your purchase arrive damaged, please contact Jean within 7 days of receipt via email (jean@jeansynodinos.com). Please describe the damage and provide images of the damaged product and packaging. If your product can’t be repaired or replaced within a reasonable time, you will receive a full refund upon return of the damaged product to the Artist. You may also apply the refund amount towards any other item(s) in the store.

OWNERSHIP OF INTELLECTUAL PROPERTY, COPYRIGHTS AND IMAGES
Unless otherwise indicated, all content on the site—text, images, video, audio, logos—are owned or controlled exclusively by the Artist or licensed to her and are protected by copyright and trademark laws of the United States and internationally. Nothing in these Terms creates permissions for others to sell, license, rent, modify, distribute, copy, reproduce, transmit, publish, adapt, edit or create derivative works without first seeking written permission from the Artist.
(That said, don’t hesitate to ask. There’s a really good chance Jean will want to work with anyone who’d like to use/adapt/publish, etc. this work. And if there’s something you particularly like on this website (e.g., a song, a painting, a blog post), you are most welcome to share it on social media any time. Just credit the Artist, okay?)
Finally, a word about images in original paintings. Once sold, the Artist reserves the right to produce prints, cards, or other physical and digital products based on the images in the original painting for an indefinite period of time.
PRIVACY
Information is collected whenever you either a) opt-in to receive periodic emails or electronic communications from the Artist, or b) purchase an item from the store. The information collected by the Artist may include contact information (your name, email address, phone number, physical address), and any payment information is collected by the Wix store application and/or PayPal. No sensitive personal information is collected (e.g., race, ethnicity, political opinions, religious or philosophical beliefs, health information, etc.). This website also uses Google Analytics to assess how visitors are using this website and its store. Google Analytics includes information about visitor interactions (e.g. IP addresses, referral information, devices and browsers used).
Information may be used to promote the website or its products through occasional electronic communications. These might include promotional emails, outreach to ensure customer satisfaction, or communications to answer any customer questions. Any information collected by Google Analytics is used to generate aggregate, non-identifying information about how visitors use this website.
The Artist will never share any information collected and available to her with any third party. Should users opt-in to receive promotional emails, they may choose to opt-out at any time. Finally, this site is hosted by Wix which follows industry standards on information security management to safeguard personal and sensitive information.
INDEMNIFICATION
You agree to indemnify and hold the Artist harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against her by any third party due to, or arising out of, or in connection with your use of the website or any of the products or services offered on the website.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall the Artist be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, this website and her music/art.
To the maximum extent permitted by applicable law, the Artist assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of this website; and (iii) any unauthorized access to or use of the website’s secure servers and/or any and all personal information stored therein.
RIGHT TO CHANGE OR MODIFY TERMS
The Artist reserves the right to modify these terms at her sole discretion. Therefore, if you like wading through legalese (and it appears you do!), you’re encouraged to sit down with your favorite beverage and review these Terms periodically. Should the Artist change the Terms in a material manner, you’ll be notified, and your continued use of the website and its store after any such change will mean you’re okay with and accept the revised Terms. If you don’t agree to any of these terms or any future version of the Terms, then Jean wishes you well as you close the proverbial door on this website and its store.
PROMOTIONAL EMAILS AND YOUR PRIVACY
You have an opportunity to opt-in to receive periodic emails that promote the Artist’s work online as well as in real life. Jean hopes you’ll click that little box when you check out or use the sign-up form on this website, but it really is up to you. In all honesty, her emails are pretty darned rare. Most importantly, Jean vows on the safety of her many guitars that she will never, ever sell your information or use it for nefarious purposes if for no other reason than The Golden Rule. It’s just the way it should be. And your privacy matters.
Should you opt-in for emails, you’re always, always able to opt out.
ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND DIGITAL SIGNATURES
Visiting this website, sending emails, and/or using online forms are each examples of electronic communications. Visitors accept that any emails, agreements, invoices, bills of sale, notices, disclosures, or other communications provided to you electronically satisfy the same legal requirement that a similar communication would be if sent in writing or by mail.
NOTICE TO CALIFORNIA RESIDENTS
In the creation of original art, the Artist may occasionally use small quantities of paints or pigments (e.g., cobalt, cadmium) that have been linked to health risks. There is minimal to no risk of exposure to heavy metals in finished paintings.
DISPUTE RESOLUTION
These Terms, the rights and remedies provided here, and any and all claims and disputes related to the Artist, this website, and its store, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United States and the State of Texas, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Austin, TX/Travis County, TX.
